Employers cannot discriminate in employment because someone has an actual or perceived disability. Determining exactly what a “disability” is requires knowledge of Hawaii law and current federal law which was recently changed to provide better and more protection to our disabled population.
The Americans With Disabilities Act
Under the Americans with Disabilities Act, employers are prohibited from discriminating against qualified individuals with a disability when making employment decisions. Employers cannot discriminate based on disabilities when considering employees for promotions or offering benefits package. Those that violate the law can be held accountable for their actions.
